Truck driver accused of causing damages to building

GRETNA – A Kenner man is being sued following an incident in which he allegedly caused damages to a building through negligent driving.

Certain underwriters at Lloyds London Subscribing to certificate No. BA 1502971 as subrogee of William J. Dwyer IV, Gilbert E. Copeland and Gilbert E. Copeland Trust filed a suit against Leo Duane Berry in the 24th Judicial District Court on May 20.

According to the claim, the defendant, Leo Duane Beery was operating a Penske rental truck on May 21, 2015, when the incident occurred. The suit states that while the defendant was driving in the parking lot at 4500 Veterans Blvd., Metairie, he came to a canopy that was attached to a building. The suit states that the truck was too high to drive under the canopy and as the defendant attempted to drive under it, it caused the canopy to become detached from the building, resulting in it resting on the power supply lines. The defendant allegedly caused damages to the Gilbert E. Copeland Trust when he damages the building.

The defendant is accused of negligent driving and failure to act reasonable and follow safe procedures.

The plaintiff is seeking an unspecified amount in damages. He is represented by Jake P. Skaggs of Cozen O'Connor in Houston, Texas. The case has been assigned to Division N Judge Stephen D. Enright Jr.
