Transportation business alleges New York company owes $102,000

Contract 02

NEW ORLEANS — A Louisiana transportation service provider is suing a New York business, alleging failure to pay more than $102,000 for a shipment of rice.

PGS USA LLC filed a lawsuit May 20 in U.S. District Court for the Eastern District of Louisiana against Popi Trading, Inc., doing business as Liner American Services NA, alleging breach of contract.

According to the complaint, PGS agreed to provide transportation services relating to the transportation and hauling of containers of rice for Liner American. Despite numerous demands for payment and full performance, the suit says, the plaintiff has not received full payment of $102,680.25 from the defendant.

PGS USA seeks a trial by jury, judgment for all amounts owed, attorney fees, costs, expenses, pre-judgment and post judgment interest and all other relief to which it is entitled. It is represented by attorneys Edward T. Hayes and Adam D. Whitworth of Leake & Andersson LLP in New Orleans.
