CVS in Metairie alleged to not be ADA compliant

NEW ORLEANS – A Metairie man is suing a pharmacy over allegations that it has barriers that restrict access to the disabled.

Stephen Carrier filed a complaint on July 10 in the U.S. District Court for the Eastern District of Louisiana against Louisiana CVS Pharmacy LLC alleging violation of the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that on May 4 he experienced serious difficulty accessing the goods and utilizing the services offered at the defendant's property in Metairie due to architectural barriers. The plaintiff holds Louisiana CVS Pharmacy LLC responsible because the defendant allegedly failed to provide a permissible cross slope along the walking surface that connects the accessible-designated parking area with the property’s entrance, and failed to provide handrails on the main entrance walking surface with a slope of more than 5 percent.

The plaintiff requests a trial by jury and seeks declaration that the defendant's property is in violation of the ADA, an order directing defendant to alter the property to make it accessible to and useable by individuals with mobility disabilities, award of reasonable attorneys’ fees, costs and expenses and such other and further relief as it deems necessary, just and proper.
