Tim Clark Construction alleges it wasn't paid in full for work on home

NEW ORLEANS – An Orleans Parish construction company is seeking damages claiming that it never received payment for work completed.

Tim Clark Construction LLC filed a suit against Janice Fraise and/or the succession of Janice Fraise in the Orleans Parish Civil District Court on June 1.

According to the claim, the defendant entered into an agreement with the plaintiff on March 16, 2011, for the elevation of a home located at 4523 Dreaux Ave. The suit states that the plaintiff completed the work in compliance with the building codes requires, however, the defendant allegedly failed to make payments in full for the work completed by the plaintiff. The suit states $30,672.21 is still owed.

The defendant is accused of failure to honor the promissory note issued and failure to pay the plaintiff for the work completed.

The plaintiff is seeking an unspecified amount in damages. The plaintiff is represented by W. Scott Duggins and David D. Duggins of the Duggins Law Firm in Metairie.

The case has been assigned to Division E Judge Clare Jupiter.
