A father is seeking damages, claiming that his minor son was attacked by a gang on the Fourth of July

NEW ORLEANS — A father is seeking damages on behalf of his minor child, who he claims was assaulted while celebrating the Fourth of July.

David Bell, individually and on behalf of his minor child, filed a suit against Cody Mire, Christian Mire and Alexander Faulk in the Orleans Parish Civil District Court on July 1.

According to the claim, the plaintiff's son was celebrating the Fourth of July in 2015 when he was allegedly assaulted and battered by the defendants, who, without warning, struck the child on the head with a bottle and punched his face repeatedly. The suit claims that the defendants continued to beat the child as he was on the ground, resulting in his need for medical attention for his concussion, broken nose, lacerations and additional injuries.

The defendants are accused of intentional assault and battery of a minor.

The plaintiffs are seeking an unspecified amount in damages. The plaintiffs are represented by Isaac H. Ryan.

The case has been assigned to Division E Judge Clare Jupiter.

The Orleans Parish Civil District Court Case number 16-6663.
