Counselor claims Ekems Healthcare failed to pay overtime wages

NEW ORLEANS — A counselor has filed suit against her former employer for allegedly violating workers compensation acts.

Cheryl L. Esquire filed a complaint July 2 in U.S. District Court for the Eastern District of Louisiana against Ekems Healthcare Inc., alleging that the former employer violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that she routinely worked more than 80 hours per every two-week period without receiving proper overtime compensation. The plaintiff holds Ekems Healthcare Inc. responsible because the defendant allegedly refused to pay her time and a half for the hours she was required to work in excess of 40 hours a week or 10 hours in a single day.

The plaintiff requests a trial by jury and seeks judgment against the defendant for damages and relief, together with legal interest, attorney's fees, costs and litigation expenses and for all relief allowable under law.
