LAFAYETTE — A California online delivery company is suing a Louisiana food delivery service, alleging trademark infringement and unfair competition.
Waiter.com Inc. of Sunnyvale, California, filed a lawsuit July 14 in U.S. District Court for the Western District of Louisiana against Waitr Inc. of Lake Charles, Louisiana, alleging violation of Louisiana's Unfair Trade Practice and Consumer Protection Law.
According to the complaint, Waiter.com has suffered irreparable financial harm to its goodwill and reputation, and damage to its business interests because the defendants offered restaurant order delivery services identical and confusingly similar to the plaintiff's services and that Waitr Inc. advertised and promoted its infringing services.
Waiter.com Inc. seek a trial by jury, a ruling the defendant be permanently restrained and enjoined from further infringing on the plaintiff's trademark, legal costs, attorney fees and such other relief the court deems proper.
