Shipbuilder accuses ex-business partners of breach of warranty

NEW ORLEANS — A Mississippi shipbuilder is suing two Louisiana companies, alleging breach of contract and breach of warranty.

VT Halter Marine Inc. of Pascagoula, Mississippi, filed a lawsuit July 15 in U.S. District Court for the Eastern District of Louisiana against A&C Machine Inc., doing business as  Flow Line Valve Controls Inc. in Schriever, Louisiana, Cajun Process Solutions Inc. of Baton Rouge, and XYZ Insurance Companies, alleging the plaintiff's ex-business partners breached implied warranty of merchantabillity.

According to the complaint, VT Halter Marine has sustained damages in an amount to be proved at trial. The plaintiff alleges the defendants misrepresented and/or omitted the true condition of valves that had been shipped, failed to supply valves which conformed to the purchase orders and failed to remediate any defective valves.

The suit says the defective valves supplied by Cajun Process and manufactured by Flow Line were installed on Bouchard barges.

VT Halter Marine seeks a trial by jury, judgment for lost time, monetary damages, plus all interest, legal costs and all other relief to which it is entitled. It is represented by attorneys David S. Bland, Julie M. Araujo, and Mallory G. Wynne of Bland & Partners PLLC in New Orleans.
