Health care providers accuse plan administrator of breaching fiduciary duty

MONROE — A Franklin Parish health care providers are suing a plan administrator, alleging breach of fiduciary duty.

Franklin Parish Hospital Service District No. 1 and Franklin Medical Center Employee Benefit Plan and Trust filed a lawsuit July 18 in U.S. District Court for the Western District of Louisiana Monroe Division against Fox Everett a Division of Hub International Solutions LLC, alleging violation of the Employee Retirement Income Security Act.

According to the complaint, the plaintiffs suffered substantial financial damages because the defendant made duplicate payments to health care providers for employee health care claims, failed to disclose its payment practice despite repeated requests and submitted false and misleading information and/or concealing information.

The plaintiffs seek a trial by jury, a full and complete accounting of all payments of plan assets made by the defendant, restitution of the over-payments made by defendant, costs, interest, attorney fees and all other equitable relief.
