Louisiana couple accuses conveyor installer of negligence

SHREVEPORT — A Louisiana couple is suing a conveyor installer and insurer, alleging professional negligence caused the husband to suffer injuries.

John D. Couch and Darlene Couch filed a lawsuit July 20 in U.S. District Court for the Western District of Louisiana Shreveport Division against Delight Fabrication LLC and XYZ Insurance Company, alleging negligence in failing to properly install the grating at the plaintiff's workplace.

According to the complaint, on Dec. 27, 2015, while working at the House of Raeford Farms poultry plant in Arcadia, John Couch sustained deep laceration to his mid-right shin while working alone in the refrigeration unit. The suit says he sustained the injuries when he stepped on the grating installed by Delight and fell through it. 

The lawsuit states the grating was not wedded down, and that Couch has sustained pain and suffering while Darlene Couch has experienced loss of consortium. 

The plaintiffs allege Delight failed to properly install proper material into a building cut or replace the grading FABED pan and put it under the conveyor. The suit says XYZ failed to indemnify Delight for damages caused by its negligence.

The Couches seek trial by jury, all damages, legal costs and interest from date of judicial demand until paid in full. They are represented by attorney Curtis R. Joseph Jr. of Winchell & Joseph LLC in Shreveport.
