Amputee accuses property owner of violating ADA

NEW ORLEANS — A Jefferson Parish man is suing a Harvey shopping center owner, alleging disability discrimination.

Lawrence Fultz, an amputee, filed a lawsuit Aug. 5 in U.S. District Court for the Eastern District of Louisiana against Krisim Investment LLC, alleging failure to comply with the Americans with Disabilities Act.

According to the complaint, on July 16, Fultz visited the defendant's property at 2405 Manhattan Blvd. in Harvey. During his visit, the suit says, he experienced serious difficulty accessing the goods and utilizing the services offered at the property due to architectural barriers. 

The lawsuit states Fultz fears he will encounter the existing mobility-related barriers when he returns to the property in the future. The plaintiff alleges Krisim Investment has failed to adopt any alternatives to barrier removal that would provide access to the accommodations offered for public use at the property.

Fultz seeks trial by jury, declaration that the property owned, leased, and/or operated by the defendant violates the ADA, an order directing the defendant to make the property accessible to and usable by individuals with mobility disabilities, reasonable attorney fees, plus other legal expenses and all relief as the court deems proper.
