NEW ORLEANS — A patient is suing the manufacturer of a prosthesis, alleging violation of consumer protection statutes.
Savannah Davis filed a lawsuit Aug. 8 in U.S. District Court for the Eastern District of Louisiana against Zimmer Inc., Zimmer Holdings Inc. and Zimmer Orthopaedic Surgical Products Inc. alleging failure to warn and negligence.
According to the complaint, on Jan, 20, 2012, Davis was implanted with a Zimmer NexGen Knee device in her left knee and underwent revision surgery May 30, 2016.
The suit says Davis continues to have complications and may be undergoing additional revision surgeries. She has suffered and will continue to suffer personal and economic injuries, the lawsuit states.
The plaintiff alleges the defendants defectively designed and manufactured the Zimmer NexGen Knee devices .
Davis seeks a trial by jury, compensatory damages, punitive or exemplary damages, statutory damages, attorney fees and legal costs, pre-judgment interest and all relief the court deems just and proper.
