Patient claims root canal caused injury

GRETNA – A woman claims that she was caused hemorrhaging during a root canal.

Joy B. Mims filed a suit against Niobe Ali Joseph DDS in the 24th Judicial District Court on Aug. 16.

According to the claim, the defendant performed a root canal on the plaintiff on Sept. 2, 2014. The suit states that the plaintiff was caused to suffer intense pain and suffering due to the fault of the defendant, who was then unable to control the plaintiff's mouth's bleeding. The incident allegedly resulted in hemorrhaging.

The defendant is accused of negligence through failing to provide the standard of care that he should have, failing to use the proper method of treatment for the plaintiff and failing to use the proper technique to prevent complications.

The plaintiff is seeking an unspecified amount in damages. The plaintiff is represented by T. Carey Wicker III, J. Alex Watkins and Vincent E. Odom of Capitelli & Wicker in New Orleans.

The case has been assigned to Division N Judge Stephen D. Enright Jr.
