J.C. Penney customer alleges elevator closed on him, caused injuries

GRETNA – A man claims that an elevator closed on him in J.C. Penney and injured him.

George Barley filed a suit against J.C. Penney Corp. Inc. and Kone Inc. in the 24th Judicial District Court on Aug. 16.

According to the claim, the plaintiff was a guest at the J.C. Penney located at 3301 Veterans Memorial Blvd. in Metairie on Sept. 8, 2015, when the incident occurred. The suit states that the plaintiff was caused damages when the elevator allegedly closed on his body.

The defendants are accused of negligence through their failure to provide a safe experience for customers, failing to maintain the elevator in working order and overall negligence in the situation.

The plaintiff is seeking an unspecified amount in damages. The plaintiff is represented by Julie-Ann A. Duhe'-Keating and Christopher Gross of the Keating Law Firm in Metairie.

The case has been assigned to Division L Judge Donald A. Rowan Jr.
