Man claims state, Wal-Mart are responsible for injuries caused by a hidden storm drain

NEW ORLEANS – An Orleans Parish man is seeking damages after he fell in a storm drain and was allegedly injured.

Ron Hendrick filed a suit against state of Louisiana, through the Department of Transportation and Development, and Wal-Mart Store East Inc. in the Orleans Parish Civil District Court on Aug. 25.

According to the claim, the plaintiff was walking in front of the Walmart located at 4001 Behrman Highway on Sept. 4, 2015, when the incident occurred. The suit states that the plaintiff was caused injury when he fell into a storm drain that was hidden by tall grass.

The defendants are accused of negligence through their failure to keep the grass trimmed so that the storm drain would be visible and failure to warn of the condition.

The plaintiff is seeking an unspecified amount in damages. He is represented by Troy R. Keller and John E. Sudderth of Metairie.

The case has been assigned to Division A Judge Tiffany G. Chase.
