NEW ORLEANS – An insurer is seeking declaratory relief from the court in a dispute over a claim for underinsured motorist coverage filed by a St. Tammany Parish family.
Federated Rural Electric Insurance Exchange filed a complaint on Aug. 26 in the U.S. District Court for the Eastern District of Louisiana against
Irish Jourdan, Robin Rene Jourdan and Misty Michelle Jourdan Appe seeking declaratory judgment.
According to the complaint, the plaintiff issued an insurance policy to the Washington St. Tammany Electric Cooperative Inc. The plaintiff alleges that as a result of an automobile accident of March 8 that killed defendants' decedent
Lawrence Jourdan while he was crossing a street,
it received a claim for uninsured motorist benefits from the defendants.
The plaintiff claims that it is not responsible for insuring the decedent because at the time of the said accident, he was not in the course of his employment nor was occupying any vehicle.
The plaintiff requests a trial by jury and seeks an order that it is not obligated to provide uninsured motorist coverage for the incident of March 8 and for all other and equitable relief. It is represented by James M. Benson and David L. Bordelon of Ungarino Eckert LLC in Metairie.
