Amtrak passenger alleges he was injured in incident between train, tractor-trailer

NEW ORLEANS – A passenger alleges he was injured in a collision between a train and tractor-trailer while traveling from Chicago to New Orleans.

Arnold Murphy filed a complaint in the U.S. District Court for the Eastern District of Louisiana against Clark Gin Service Inc., State Farm Mutual Automobile Insurance Co. and National Railroad Passenger Corp. alleging negligence.

According to the complaint, the plaintiff alleges that on Sept. 10, 2013, he was a passenger aboard Amtrak train The City of New Orleans when he sustained severe injuries to his mind and body when he was violently thrown about the train due to a collision with a tractor-trailer owned by Clark in Mississippi. The plaintiff holds Clark Gin Service Inc., State Farm Mutual Automobile Insurance Co. and National Railroad Passenger Corp. responsible because Clark's driver allegedly failed to maintain proper lookout and failed to observe ordinary care and caution. He alleges Amtrak failed to warn its passengers of an impending collision and failed to provide reasonable assistance immediately prior to and at the time of the collision.

The plaintiff requests a trial by jury and seeks judgment against defendants, jointly, severally, and in solido, for damages of more than $75,000, plus interest and costs, attorney’s fees, court costs and all equitable relief.
