Man alleges debt collectors garnished wages for debt he doesn't owe

NEW ORLEANS – A Gretna man alleges his wages are being garnished for a debt he does not owe.

Reginald Marcotte filed a complaint on Sept. 6 in the U.S. District Court for the Eastern District of Louisiana against Enterprise Recovery Systems Inc., Navient Solutions Inc. and United Students Aid Funds alleging that they violated the Louisiana Unfair Trade Practices and Consumer Protection Act and the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that in May, defendant Enterprise Recovery Systems Inc., on behalf of defendant United Students Aid Funds and Navient Solutions Inc., served a federal wage garnishment on his employer. He alleges he does not owe a debt to the defendants. Due to the defendants' actions, the plaintiff alleges he has suffered financial and economic losses. The plaintiff holds Enterprise Recovery Systems Inc., Navient Solutions Inc. and United Students Aid Funds responsible because the defendants allegedly are attempting to collect an alleged debt, are currently garnishing his wages to satisfy an alleged debt of $954.28 owed to defendants USAF and NSI and refused to provide with any documentation related to the alleged debt.

The plaintiff requests a trial by jury and seeks judgment against defendants, statutory damages, actual damages, costs and attorney’s fees, punitive damages and any other relief the court deems appropriate. He is represented by Samuel J. Ford of Varadi, Hair & Checki LLC in New Orleans.
