Academy Training School, Progressive Buildings accused of wage violations

LAKE CHARLES — A licensed practical nurse from Calcasieu Parish is suing joint employers, alleging violation of the Fair Labor Standards Act.

Carolyn Harper filed a complaint on Sept. 7 in the U.S. District Court for the Western District of Louisiana Lake Charles Division against Academy Training School LLC and Progressive Buildings LLC, alleging failure to pay proper overtime compensation.

According to the complaint, the plaintiff alleges that she was required to be on call, to perform duties outside the scope of her employment and to stay at work longer than her scheduled hours without receiving overtime compensation. The plaintiff holds the defendants responsible, alleging that they failed to keep and preserve adequate and accurate time and wages records and failed to compensate her at a rate of one and one-half times her regular rate for all hours worked in excess of 40 per week.

The plaintiff requests a trial by jury and seeks judgment against the defendants for compensatory damages, liquidated damages, attorney's fees and for all equitable relief as the court deems proper. She is represented by James E. Sudduth III of Sudduth & Associated LLC in Lake Charles.
