NEW ORLEANS – Five people have filed a suit to compel action on their I-485 applications, which they allege have been on file since 2012 and 2014.
Bin Zhang, Xinmei Zheng, Minghong Zhang, Mingyi Zhang and Zhuwei Zhang filed a complaint on Sept. 13 in the U.S. District Court for the Eastern District of Louisiana against the district director, United States Citizenship and Immigration Services, Department of Homeland Security, Federal Bureau of Investigations and the United States of America.
According to the complaint, the plaintiffs allege that they have suffered damages for the delay on the decision on their permanent residency applications or to adjust status. They have requested numerous times, most recently on March 1, without success, the suit states. The plaintiffs holds district director, United States Citizenship and Immigration Services, Department of Homeland Security, Federal Bureau of Investigations and the United States of America responsible because the defendants allegedly failed to adjudicate the plaintiffs' permanent residency applications, failed and refused to complete their cases and failed to provide legitimate explanation for the delay.
The plaintiffs request a trial by jury and seek an order compelling defendant district director of the USCIS at Texas Service Center to perform his duty to rule upon their I-485 applications, grant attorney's fees and costs of court and such other relief as may be proper.
