Dodge Durango has exhaust manifold defects, couple alleges

NEW ORLEANS – A couple claims a Dodge vehicle they purchased contained defects and seeks rescission of the sales contract.

Nicole and Jose Flores filed a complaint on Oct. 5 in the U.S. District Court for the Eastern District of Louisiana against FCA US LLC alleging that the automobile dealer violated the Louisiana Redhibition Law and other counts.

According to the complaint, the plaintiffs allege that on March 19, 2015, they purchased a new 2014 Dodge Durango that had converter and exhaust manifold defects and other issues. They allege such defects substantially impaired its use, safety and value. The plaintiffs holds FCA US LLC responsible because the defendant allegedly defectively manufactured the Durango, failed to repair the vehicle in a good and workmanlike manner so as to bring it into conformity with the warranties and failed and refused to buy back plaintiff's defective Durango.

The plaintiffs request a trial by jury and seek rescission of the sales contract and returning plaintiffs' purchase price, award for out-of-pocket expenses, economic losses, litigation expenses and all other relief that the court deems appropriate. They are represented by Richard C. Dalton of Richard C. Dalton LLC in Mandeville.
