NEW ORLEANS – A New Orleans company alleges it was not paid for construction work done on a federal project.
United States, for the use and benefit of Woodward Design + Build LLC, filed a complaint on Oct. 6 in the U.S. District Court for the Eastern District of Louisiana against Clark McCarthy Healthcare Partners, doing business as Clark McCarthy Construction; Travelers Casualty; and Federal Insurance Co. alleging that they failed to comply with the Miller Act.
According to the complaint, the plaintiffs allege that on Oct. 12, 2012, Woodward entered into a subcontract agreement with Quality Iron Fabricators, who had a contract with defendant McCarthy, for the installation of miscellaneous steel on the Department of Veterans Affairs' EWP-06 project. To date, the total outstanding balance of $444,059.20 remains unpaid, the suit states.
The plaintiffs hold Clark McCarthy Healthcare Partners, doing business as Clark McCarthy Construction; Travelers Casualty; and Federal Insurance Co. responsible because despite repeated demands, defendants allegedly refused to make such payments.
The plaintiffs requests a trial by jury and seeks judgment in its favor and against defendants for the principal amount of $444,059.20, plus interest, attorney's fees and costs and for all other relief as the court deems appropriate.
