NEW ORLEANS – An Orleans Parish resident alleges she was injured in an accident with a FedEx delivery driver at an intersection.
Ardell Walters and Robert G. Walters filed a complaint on Oct. 13 in the U.S. District Court for the Eastern District of Louisiana against Federal Express Corp., FedEx Ground Package System Inc. and Protective Insurance Co. alleging negligence.
According to the complaint, on Dec. 14, 2015, Ardell Walters was operating a pickup truck and approaching the intersection of Sergeant Alfred Drive when suddenly her vehicle was struck by a truck being operated by defendant FedEx's employee. Ardell Walters alleges she suffered severe and disabling injuries and plaintiff Robert Walters alleges he suffered a loss of consortium and society.
The plaintiffs holds Federal Express Corp., FedEx Ground Package System Inc. and Protective Insurance Co. responsible because defendant FedEx's employee allegedly failed to obey the traffic control device, failed to stop at a stop sign and failed to yield right of way.
The plaintiffs request a trial by jury and seek judgment against defendants in an amount reasonable under the circumstances, plus all costs and interest, and for any additional relief as the law may require.
