Toyota owner alleges airbags deployed without warning, caused injuries

GRETNA – A woman claims that her airbag deployed without a collision to trigger it and caused her injuries.

Luz Pacheco filed a suit against Toyota Motor Corp., Toyota Motor Sales U.S.A. Inc., Toyota Motor North America Inc., Toyota Motor Manufacturing Canada, Takata Corp. and TK Holdings Inc. in the 24th Judicial District Court on Nov. 4.

According to the claim, the plaintiff was driving her 2003 Toyota Matrix when the incident occurred on Nov. 6, 2015. The suit states that the plaintiff was driving normally when the airbags for both the driver and passenger deployed, repelling shrapnel and metal pieces with great force, resulting in injuries to the plaintiff.

The defendants are accused of negligence through failing to design, manufacture and test the airbag system to prevent it from deploying with an excessive force.

The plaintiff is seeking an unspecified amount in damages. The plaintiff is represented by Miguel A. Elias, Paula J. Ferreira, Rolando Padilla, Jahida L. Lewis, Meagan Smith, Sean M. Regan and Maria Vargas of the Law Office of Miguel A. Elisa in Kenner.

The case has been assigned to Division A Judge Raymond S. Steib Jr.
