NEW ORLEANS – A New Orleans resident alleges a president and several companies failed to negotiate in good faith.
W. Christopher Beary filed a complaint on Oct. 21 in the U.S. District Court for the Eastern District of Louisiana against David W. Deese, Quinco Electrical Inc., Quinco Services Inc., et al. alleging fraud, breach of contract and unfair trade practices.
According to the complaint, the plaintiff alleges he and the defendants entered into a valid letter of intent for the plaintiff to purchase the assets of the Quinco corporations. The plaintiff holds the defendants responsible because the defendants allegedly failed to fully cooperate during the due diligence period, failed to provide full access to their contracts, books and records and failed to negotiate the closing documents in good faith.
The plaintiff requests a trial by jury and seeks judgment against all defendants, in solido, in an amount to be determined at trial, plus post-judgment interest, attorneys’ fees and costs and all other relief relief that the court deems proper.
