Man alleges he fell in Winn-Dixie bathroom that was not ADA compliant

NEW ORLEANS – A handicapped man claims that he fell in a Winn-Dixie bathroom.

Louis Sonier filed a suit against Winn-Dixie Montgomery LLC in the Orleans Parish Civil District Court on Nov. 4.

According to the claim, the plaintiff was a customer at the Winn-Dixie at 5400 Tchoupitoulas on July 7. The suit states that the plaintiff tried to enter the bathroom stall with the store-provided scooter, but that the scooter would not fit through the door. When the plaintiff attempted to stand up and walk into the stall, he fell and was injured, the suit states.

The defendant is accused of failing to provide scooters that would fit into the bathroom stall in violation of the Americans with Disabilities Act and negligence.

The plaintiff is seeking an unspecified amount in damages. The plaintiff is represented by Darleen M. Jacobs in New Orleans

The case has been assigned to Division E Judge Clare Jupiter.
