LAFAYETTE — A carpenter has filed a class-action lawsuit against Travis Buquet Construction LLC, Travis Buquet Home Builders LLC, and Travis Buquet, employers, citing alleged violation of workers compensation acts.
Sergio Mejia filed a complaint on behalf of and other persons similarly situated in the U.S. District Court for the Western District of Louisiana against the defendants alleging that they violated the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that he was never paid one-and-a-half times his regular hourly rate for all hours worked in excess of 40 hours a week. The plaintiff holds Travis Buquet Construction LLC, Travis Buquet Home Builders LLC, and Travis Buquet responsible because the defendants allegedly treated him as exempt from the FLSA’s overtime requirements and refused to compensate him premium pay for all hours worked in excess of 40 per week.
The plaintiff requests a trial by jury and seeks compensation for all unpaid overtime wages due and owing, plus interest, attorneys’ fees and costs of this action, and such other relief as the court deems equitable. He is represented by Roberto Luis Costales and Emily A. Westermeier of Costales Law Office in New Orleans and William H. Beaumont of Law Office of William H. Beaumont in New Orleans.
