Amtrak employee blames truck owner, rail company for injuries

NEW ORLEANS — An Amtrak on-board service attendant is suing a truck owner, insurer and rail operator, alleging negligence led to injuries for the plaintiff. 

Donald Ryan Sullivan of Tickfaw, Louisiana, filed a complaint Oct. 26 in U.S. District Court for the Eastern District of Louisiana against Davidson Trucking, Inc. The Travelers Casualty Company and The National Railroad Passenger Corporation (Amtrak), alleging failure to comply with the Federal Employer's Liability Act.

According to the complaint, on Nov. 6, 2015, while Sullivan was working for Amtrak, a dump truck owned by Davidson negligently crossed the railroad tracks resulting in a collision that caused the plaintiff to sustain serious injuries. 

The plaintiff alleges Amtrak failed to provide a safe place to work, traveled at a speed greater than the established timetable speed and Davidson, through its driver David Wayne Hatcher, recklessly drove onto a multitrack railroad crossing.

Sullivan seeks trial by jury, damages sufficient to fully compensate him for the damages and losses he suffered, plus court costs, disbursements and all other appropriate relief.
