NEW ORLEANS — A Louisiana building materials distributor is suing a Slidell custom machine manufacturer, alleging breach of contract.
Esulation LLC filed a lawsuit Nov. 7 in U.S. District Court for the Eastern District of Louisiana against McGuckin & Pyle, Inc. alleging failure to comply with the Louisiana Products Liability Act.
According to the complaint, Esulation sustained substantial monetary damages for loss of earnings, loss of business opportunities and loss of business good will. because the defendant has failed to design and produce a flame laminator that could manufacture the plaintiff's signature product. The suit says McGuckin & Pyle has even failed to provide a complete operations manual for the machine, which is broken.
Esulation seeks trial by jury, compensation for all reasonable damages plus interest, along with attorney fees and costs of court and all relief necessary. It is represented by attorneys Normand F. Pizza and Thomas S. Schneidau of Milling Benson Woodward LLP in Mandeville.
