BATON ROUGE – An East Baton Rouge Parish man claims a Baton Rouge company engaged in unfair mortgage servicing practices.
Thomas H. Hudson filed a complaint on Dec. 6 in the U.S. District Court for the Middle District of Louisiana against Bayview Loan Servicing LLC, Equifax Information Services LLC and Experian Information Solutions Inc. citing the Fair Credit Reporting Act and the Real Estate Settlement Procedures Act.
According to the complaint, the plaintiff alleges that he had a mortgage on his home through Wells Fargo Home Mortgage and was in an agreement with it for a temporary repayment plan of 24 months. The suit states the mortgage was transferred to Bayview, who allegedly ignored this plan and sent the plaintiff notices of default and threatening foreclosure. The plaintiff alleges Bayview acknowledged the plan in December 2015, but contains to harass him with quarterly letters.
The plaintiff holds Bayview Loan Servicing LLC, Equifax Information Services LLC and Experian Information Solutions Inc. responsible because the defendants allegedly failed to assure accuracy in plaintiff's consumer reports and failed to comply with the reinvestigation requirements in 15 U.S.C. § 1681i(a).
The plaintiff requests a trial by jury and seeks compensation for all damages, attorney’s fees and costs and such other and further relief as is appropriate. He is represented by Garth J. Ridge in Baton Rouge.
