Plaisance Dragline and Dredging Co. alleged to have not provided safe working environment

NEW ORLEANS – A seaman claims he was injured because of a stuck hatch on a ship.

Roy Joseph Thibodaux filed a complaint on Dec. 6 in the U.S. District Court for the Eastern District of Louisiana against Plaisance Dragline and Dredging Co. Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on July 15, 2016, he was injured while working aboard defendant's M/V Ms. Michelle. He claims he was injured when he lifted a hatch that unexpectedly stuck and hurt his back. As a result, he alleges he has suffered physical and mental pain, disability and embarrassment. The plaintiff holds Plaisance Dragline and Dredging Co. Inc. responsible because the defendant allegedly failed to provide a safe place to work and negligently allowed the dangerous condition to exist on the deck of the vessel.

The plaintiff requests a trial by jury and seeks monetary relief of $2 million, plus interest, costs and disbursement, maintenance and cure, litigation costs and such other general and equitable relief. He is represented by C. Arlen Braud II and Michelle O. Gallagher of Braud & Gallagher LLC in Mandeville.
