Motorist alleges distracted Con-Way driver struck her vehicle, caused injuries

NEW ORLEANS – A motorist claims she was injured when she was rear-ended by a truck on Citrus Boulevard.

Mary L. Latulas filed a complaint on Dec. 7 in the U.S. District Court for the Eastern District of Louisiana against Nick C. Edwards, Con-Way Truckload Inc. and Safeco Insurance Co. of Oregon alleging negligence.

According to the complaint, the plaintiff alleges that on Dec. 8, 2015, she was operating her motor vehicle in a safe and careful manner on Citrus Boulevard in the second right turn lane turning onto Dickory Avenue when she was struck from the rear by defendant Con-Way's truck being by driven by Edwards. She alleges the accident caused her to suffer damages and injuries resulting physical and mental pain, lost wages and medical expenses. The plaintiff holds Edwards, Con-Way Truckload Inc. and Safeco Insurance Co. of Oregon responsible because defendant Edwards allegedly failed to exercise due care under the circumstances and carelessly drove the vehicle while distracted.

The plaintiff requests a trial by jury and seeks compensation for all damages, court costs, expert witness fees and legal interest. She is represented by James A. Hatch and Paul E. Mayeaux of Hatch Injury Law in Metairie.
