Baton Rouge resident accuses Ocwen Loan Servicing of wrongful conversion

BATON ROUGE – A Baton Rouge resident claims a loan servicing company has not returned endorsed insurance proceed checks in a timely manner so that he can make repairs to his home.

Arthur R. Thomas filed a complaint on Dec. 9 in the U.S. District Court for the Middle District of Louisiana against Ocwen Loan Servicing LLC alleging wrongful conversion and unlawful retention of insurance proceeds.

According to the complaint, the plaintiff alleges that in 2016, he during the period of Aug. 12-13, his home sustained water damages. The plaintiff holds Ocwen Loan Servicing LLC responsible because the defendant allegedly wrongful converted and/or unlawfully retained plaintiff’s flood insurance proceeds, totaling $69,500. As a result of defendant's actions, he has suffered and continues to suffer damages for the unnecessary and costly delays to the reconstruction of his home and other damages, including at least two burglaries to his home because he has not been able to occupy it.

The plaintiff requests a trial by jury and seeks compensation for damages in the sum of $200,000, plus interest, attorneys' fees, costs and such other relief. He is represented by Arthur R. Thomas and Ernest L. Johnson of Arthur R. Thomas & Associates LLC in Baton Rouge.
