FitzGerald Contractors alleges it is still owed more than $5,000 for work on project

LAKE CHARLES – A Shreveport subcontractor alleges it was not paid in full for work on a federal project in Vernon Parish.

United States of America, for the use of FitzGerald Contractors LLC, filed a complaint on Dec. 14 in the U.S. District Court for the Western District of Louisiana, Lake Charles Division against Blackhawk Ventures LLC and Travelers Casualty and Surety Co. of America citing the Miller Act and breach of contract.

According to the complaint, the plaintiffs alleges that between Sept. 26, 2012, and March 4, 2016, FitzGerald Contractors provided additional labor, materials and equipment needed by Blackhawk Ventures to complete a project with the U.S. Army Corps of Engineers. To date, they allege an outstanding balance of $5,792 remains due and unpaid. The plaintiff holds Blackhawk Ventures LLC and Travelers Casualty and Surety Co. of America responsible because the defendants allegedly failed and refused to make payments for all amounts due.

The plaintiffs seek judgment against defendants for all damages, together with interest, costs and expenses for this action and all other just and equitable relief. They are represented by Michael D. Lowe of Kean Miller LLP in Shreveport.
