NEW ORLEANS – A financial institution alleges it is owed more than $300,000 on a promissory note in default.
Midsouth Bank NA filed a complaint on Dec. 20 in the U.S. District Court for the Eastern District of Louisiana against the M/V TLC Explorer, Ray Pierre Duprene and TLC Marine Services Inc. alleging breach of promissory note.
According to the complaint, the plaintiff alleges that on Nov. 26, 2012, defendants executed and delivered to plaintiff a promissory note in the amount of $480,000. The plaintiff alleges the principal sum of $349,148.77 remains due and unpaid. The plaintiff holds M/V TLC Explorer, Duprene and TLC Marine Services Inc. responsible because the defendants allegedly failed to make payments when due.
The plaintiff requests a trial by jury and seeks an order declaring that plaintiff is the holder of a valid first preferred mortgage lien on the vessel and award for any deficiency including attorney's fees, expenses and costs that may be due.
