NEW ORLEANS – An Edgar man alleges he was injured in accident in Houston with a Seattle driver.
Jammal Comminie filed a complaint on Dec. 23 in the U.S. District Court for the Eastern District of Louisiana against the Empire Fire and Marine Insurance Co., Enterprise Rent-A-Car Co., 21 Century Ins. Co. and Dorothy L. Fowler alleging negligence.
According to the complaint, the plaintiff alleges that on June 20, 2016, he was safely operating a 2008 Ford F150 headed eastbound on Westpark Road near in its intersection with Shadow Briar Road in Houston, Texas when suddenly and without warning defendant Fowler recklessly attempted to turn left against the flow of traffic and violently struck plaintiff’s vehicle. The plaintiff alleges this incident resulted in serious injuries and damages, pain, suffering and anguish, lost wages and medical expenses.
The plaintiff holds Empire Fire and Marine Insurance Co., Enterprise Rent-A-Car Co., 21 Century Ins. Co. and Fowler responsible because defendant Fowler allegedly failed to keep a proper lookout and failed to exercise reasonable vigilance. The suit states Fowler was driving a car owned by Enterprise Rent-A-Car.
The plaintiff requests a trial by jury and seeks judgment against defendants, jointly, severally and in solido, in an amount that will reasonably compensate him for his damages, plus interest, all costs of the proceedings and all equitable relief that the court may deem necessary. He is represented by Dennis D. Spurling in Houston.
