Daughter files suit against insurance company, estate planners for alleged negligence

ALEXANDRIA – A Tennessee woman is accusing a firm of breach of the applicable standard of care in relation to her late mother's will.

Diane Wilkins filed a complaint on Jan. 4 in the U.S. District Court for the Western District of Louisiana against Continental Casualty Co., Hoyt & Stanford LLC and Ted Hoyt alleging negligence.

According to the complaint, the plaintiff alleges that she suffered damages for not getting the living trust assets of more than $900,000 from her mother's estate as specified by her mother's last will and testament. The plaintiff holds Continental Casualty Co., Hoyt & Stanford LLC and Ted Hoyt responsible because the defendant allegedly failed to advise plaintiff's mother that to accomplish her wishes to leave everything to plaintiff, she must first revoke a living trust.

The plaintiff requests a trial by jury and seeks judgment against all defendants for all of her damages, plus interest, costs of the suit and all other relief to which she may show herself entitled. She is represented by S. Bradley Rhorer and Zachary S. Walker of Rhorer Law Firm in Baton Rouge.
