Maritime employer accuses floorhand of false pretenses in failing to return to work

NEW ORLEANS — A maritime employer is suing a floorhand, alleging false or misleading pretenses.

Coastal Drilling Company LLC filed a complaint Jan. 7 in U.S. District Court for the Eastern District of Louisiana against Brandon Creel, alleging failure to return to work.

According to the complaint, Coastal Drilling has suffered and will continue to suffer monetary injuries for continuing to pay further maintenance and/or cure benefits to Creel. The plaintiff alleges Creel has failed to return to work since July 26, 2016, despite being released from physicians to return to work with limitations after he suffered work-related injuries earlier that month.

Coastal Drilling seeks trial by jury, an order declaring Creel is not entitled to maintenance and cure, is not entitled to damages, punitive damages and attorney fees, that Creel is obliged to return and/or a credit for benefits paid under false or misleading pretenses, and all other equitable relief.
