Ophthalmologist alleges Retina Specialty Institute did not provide partnership papers

NEW ORLEANS – An Orleans Parish ophthalmologist alleges his employer failed to timely provide executed partnership papers to him.

Sean O’Sullivan MD filed a complaint on Jan. 25 in the U.S. District Court for the Eastern District of Louisiana against Sunil Gupta MD LLC, doing business as Retina Specialty Institute; Sunil Gupta; Magdalena Shuler; John Myers; and Alan Franklin alleging breach of contract and other counts.

According to the complaint, the plaintiff alleges that he was hired by Retina Specialty Institute in 2012 and it was represented to him that he would be advised if he could purchase an equity membership in the company in 2014. The plaintiff holds the defendants responsible because the defendants allegedly failed to provide the requisite equity membership papers for buy-in and failed to make him a partner in accordance with the terms of their agreement.

The plaintiff requests a trial by jury and seeks judgment against defendants for liquidated damages, attorneys’ fees, costs and expenses and such other just and proper relief. He is represented by Kim M. Boyle and Maryjo L. Roberts of Phelps Dunbar LLP in New Orleans.
