Consumer claims GMC Savana Caravan has defects

NEW ORLEANS – A man claims a recreational vehicle he purchased is defective and seeks rescission of the sales contract.

Harold L. Vardano filed a complaint on Jan. 31 in the U.S. District Court for the Eastern District of Louisiana against General Motors LLC and Morgan Buick GMC Shreveport Inc. citing Louisiana Redhibition Laws, the Magnuson-Moss Warranty Act and other counts.

According to the complaint, the plaintiff alleges that on April 27, 2016, he purchased a new 2016 GMC Savana Caravan from defendant Morgan Buick for a total cost of more than $100,000. When delivered, he alleges the vehicle was defective in materials and workmanship and that such defects substantially impaired its use, value and safety. The plaintiff holds General Motors LLC and Morgan Buick GMC Shreveport Inc. responsible because the defendants allegedly failed to perform repair work in a good and workmanlike manner so as to bring it into conformity with the warranties.

The plaintiff requests a trial by jury and seeks the remedy of rescission of the sales contract, revocation of acceptance, award for incidental and consequential damages, diminution in value of the vehicle, economic losses, attorney fees, costs and expenses and all other appropriate relief.
