Rouge House owner files suit over alleged denial of alcohol permit

NEW ORLEANS – A Plaquemines Parish veteran and owner of the Rouge House alleges her constitutional rights were violated in her application for an alcohol permit for her business.

Tracy Riley filed a complaint on Jan. 19 in the U.S. District Court for the Eastern District of Louisiana against the Office of Alcohol and Tobacco Control of the Louisiana Department of Revenue, Jeffrey Barthelemy, et al. alleging that they violated the Fourth, Fifth, Eighth and 14th Amendments of the U.S. Constitution.

According to the complaint, the plaintiff alleges that as a result of defendants' wrongful acts, plaintiff has suffered and will continue to suffer monetary damages for loss of use and enjoyment of property and fines. The plaintiff holds Office of Alcohol and Tobacco Control of the Louisiana Department of Revenue, Jeffrey Barthelemy, et al. responsible because the defendants allegedly deliberately disregarded her constitutional rights and conspired together to deny and refuse her application for alcohol permit.

The plaintiff requests a trial by jury and seeks punitive damages, plus interest, attorney's fees and costs of these proceedings and all other equitable and injunctive relief. She is representing herself.
