Woman claims Hartford Life and Accident Insurance wrongfully denied benefits

NEW ORLEANS – A Jefferson woman alleges her claim for disability benefits was wrongfully denied.

Catherine A. Bayhi filed a complaint on Feb. 3 in the U.S. District Court for the Eastern District of Louisiana against Hartford Life and Accident Insurance Co. alleging that the plan administrator violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she has suffered, and is continuing to suffer economic losses as a result of not receiving disability benefits due to her. The plaintiff holds Hartford Life and Accident Insurance Co. responsible because the defendant allegedly unlawfully denied her benefits under terms of the disability policy by failing to consider her medical condition in relation to the actual duties of her occupation.

The plaintiff requests a trial by jury and seeks judgment against defendant for all benefits due to her, plus pre- and post-judgment interest, attorney fees, costs of suit and all other relief as the law may provide. She is represented by James F. Willeford and Reagan L. Toledano of Willeford & Toledano in New Orleans.
