Woman alleges she was injured in accident with USPS employee

Car accident 16

NEW ORLEANS – A woman alleges she was injured in an accident with a federal employee and that her claim for damages was denied.

Ethel Depron filed a complaint on Feb. 8 in the U.S. District Court for the Eastern District of Louisiana against the United States Postal Service and Calvin Daiz Jr. alleging negligence.

According to the complaint, the plaintiff alleges that on Aug. 11, 2015, she sustained injuries when defendant Daiz, acting as an employee of the United States Postal Service, negligently collided with the vehicle in which plaintiff was a passenger. As a result, plaintiff alleges she incurred $2,705 in medical expenses. The suit states that on Aug. 11, 2016, she submitted a claim for damages and injury to defendant via certified registered mail. The plaintiff holds United States Postal Service and Daiz Jr. responsible because on Oct. 4, 2016, defendants allegedly denied to pay her administrative claim.

The plaintiff requests a trial by jury and seeks judgment against defendants in an amount of damages as alleged in her petition, plus penalties, costs of this suit and for all other general and equitable relief. She is represented by Tim L. Fields and Jonathan D. Wasielewski of Law Office of Tim L. Fields in New Orleans.
