Sons file suit against Whistler Energy II LLC, Gemini Insurance Co. alleging wrongful death

NEW ORLEANS – Two Mississippi residents allege their father was killed because of a company's negligence.

Korey Miller and Zachary Miller filed a complaint on Feb. 23 in the U.S. District Court for the Eastern District of Louisiana against Whistler Energy II LLC and Gemini Insurance Co. alleging wrongful death.

According to the complaint, the plaintiffs allege that on March 10, 2016, plaintiffs' father, Roy Carroll Miller, was working in the course and scope of his employment with Nabor Offshore Corp. upon a fixed platform. While working, the suit states he suffered painful and fatal injuries when a quantity of cement accumulated in a gas buster. The plaintiffs holds Whistler Energy II LLC and Gemini Insurance Co. responsible because defendant Whistler allegedly failed to properly engineer, manage and or supervise the operation on the platform and failed to appropriately select the equipment to be used on the operation.

The plaintiffs request a trial by jury and seek judgment against defendants in such amount that may be determined by jury, plus interest, cost of these proceedings and all other relief as may be available. They are represented by Scott E. Silbert of Silbert, Garon, Pitre & Friedman in New Orleans.
