NEW ORLEANS – A Louisiana man is suing New Orleans property owners, blaming them for his fall down an elevator shaft.
William D. Berry filed a lawsuit Feb. 8 against Millennium Group LLC, Millennium Group II LLC, 327 Bourbon Street LLC, Karno 327 Bourbon Real Estate LLC, Temptations Inc., and the Princeton Excess and Surplus Lines Insurance Company in Orleans Parish Civil District Court, alleging negligence.
According to the complaint, on March 7, 2016, Berry was contracted to work at the defendants' premises at 325 Bourbon St., New Orleans. While on the property, the suit says, Berry opened a door at 327 Bourbon St., and when he took one step in a dark room he fell down an elevator shaft.
The lawsuit states Berry suffered unconsciousness, a shattered and crushed T12 vertebrae and had to undergo surgery.
The defendants are accused of negligently failing to provide a safe environment for contractors, failing to properly mark the elevator shaft and overall negligence.
Berry seeks all reasonable damages, court costs, attorney fees and all appropriate relief. He is represented by attorney James A. Crouch of Metairie.
The case has been assigned to Division G Judge Robin M. Giarrusso.
