Tenant alleges neighbor's clogged toilet caused damage to his unit

NEW ORLEANS – An Orleans Parish man is suing apartment owners, alleging a neighbor's leaky toilet caused nearly $40,000 in damages to his his unit.

Thomas Keaty filed a lawsuit Jan. 25 against Kiran S. Trivedi, Rita C. Trivedi, Rifhi Trivedo and Gulfstream Property and Casualty Insurance Company in Orleans Parish Civil District Court, alleging negligence.

According to the complaint, on Jan. 29, 2016, a toilet in the defendants' unit at 1750 St. Charles Ave., New Orleans, overflowed and seeped through to Keaty's unit, causing damages of $39,560.

  

The suit says the defendant's insurance company compensated Keaty for damages caused by the leak but has failed to pay in the proper amount to fully compensate for all the damages.

The defendants are accused of negligently failing to fix the leak in a timely fashion and failing to pay the plaintiff enough to compensate for his damages.

Keaty seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorneys Joseph C. Bartels and Victoria Lennoz Bartels of The Law Offices of Joseph C. Bartels in New Orleans.

The case has been assigned to Division F Judge Christopher J. Bruno.
