Former inmate alleges correctional center failed to provide medical care

NEW ORLEANS — An inmate is suing the sheriff of St. Charles Parish, the warden of a correctional center and an insurance company, citing alleged failure to provide equal protection and due process.

Anthony Belvin filed a complaint on March 1 in the U.S. District Court for the Eastern District of Louisiana against Sheriff Greg Champagne, Major Alvin Robinson, ABC Insurance Co. and John Doe 1-10 alleging that they violated the Eighth and 14th Amendments of the U.S. Constitution.

According to the complaint, the plaintiff alleges that during his incarceration at Nelson Coleman Correctional Center between Dec. 4, 2015, and March 29, 2016, he made repeated complaints of abdominal pain. On April 8, 2016, underwent surgery to remove a large inflammatory mass. As a result of the defendants’ negligence, he has suffered physical pain, emotional distress, medical expenses and loss of earning capacity. The plaintiff holds the defendants responsible because they allegedly failed to provide access to adequate or reasonable medical care and failed to act as a reasonable and prudent jailer under the same or similar circumstances.

The plaintiff requests a trial by jury and seeks judgment against defendants, jointly, severally and in solido, in a full and true sum which will compensate him for the injuries, plus interest, costs of these proceedings and for all general and equitable relief.
