Motorist blames another driver for crash

NEW ORLEANS – A St. John the Baptist motorist is suing another driver, alleging the defendant's negligence caused a car crash.

Francis Kot filed a lawsuit Feb. 21 against State Farm Mutual Automobile Insurance Company, in its capacity as uninsured/underinsured carrier, in Orleans Parish Civil District Court, alleging negligence.

According to the complaint, Kot was driving northbound on Canal Street., Feb. 28, 2015. The suit states as he came to a stop at a traffic signal, Nicholas Harris, who was driving behind, failed to stop and struck Kot's car from behind.

The suit says Kot suffered injuries to his back, neck and other parts of the body. The plaintiff alleges the settlement funds he received for $15,000 were insufficient to cover his medical expenses.

The insurance company, through Harris an uninsured driver, is accused of negligence and reckless driving of a motor vehicle.

Kot seeks all reasonable damages, court costs, attorney fees and all equitable relief. He is represented by attorney Harold L. Ehrenberg of Metairie.

The case has been assigned to Division F Judge Christopher J. Bruno.
