Woman sues over physical therapy injury

GRETNA – A St. Bernard Parish woman claims that she was seriously injured during physical therapy.

Stacy Miller, individually and on behalf of her minor child, filed a suit March 8 against Egan Health Care Corp. in the 24th Judicial District Court, alleging breach in the standard of care.

The lawsuit states that the plaintiff was admitted to West Jefferson Medical Center on Nov. 29, 2015, for blood clots in her right leg and chest. Miller was sent to Egan for therapy in December 2015, but she was unable to do what therapists asked her to do, and she came back a few days later, on Dec. 10. The plaintiff was caused to fall when she was asked to climb some steps, resulting in severe injuries to her lumbar spine and legs and causing her to be barely able to walk, the complaint said.

The defendant is accused of a breach in the standard of care through failing to take the appropriate precautions with the plaintiff, failing to know that she was at risk of falling and overall negligence.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. She is represented by David Ardoin of Ardoin, McKowen & Ory LLC in Thibodaux.

The case has been assigned to Division K Judge Ellen Shirer Kovach.
