Factory Sales and Engineering Inc. accused of failing to pay invoices

Contract 04

NEW ORLEANS – A Pennsylvania crane rental company claims a Covington energy equipment company has failed to pay invoices.

Maxim Crane Works LP filed a complaint on March 10 in the U.S. District Court for the Eastern District of Louisiana against Factory Sales and Engineering Inc., doing business as FSE Energy, alleging breach of contract and open account.

According to the complaint, the plaintiff alleges that, between September 2016 and October 2016, plaintiff leased cranes and other related construction equipment for defendant's use on multiple construction projects. To date, the sum of these invoices, $198,797.98, allegedly remains outstanding and past due. The plaintiff holds Factory Sales and Engineering Inc., doing business as FSE Energy, responsible because despite numerous demands for payment, defendant allegedly ignored to pay the said amount.

The plaintiff requests a trial by jury and seeks judgment against defendant, for all amounts due, plus penalties and interest, litigation expenses and all other equitable relief. It is represented by John T. Andrishok and Jennifer D. Sims of Breazeale, Sachse & Wilson LLP in Baton Rouge.
